A Legacy of Confusion: The Nominative Reports

From the first month of LLR assignments, you may have quickly concluded that the reporter system used to find case law is needlessly complex; the number of reporter sets can be mind-boggling and the abbreviations which must be recognized for simply looking up a case is too much of a hindrance for a law student’s busy day. To that thought, law students from 150 years ago would probably say, “hogwash!” The structure of legal citation now reflects extreme uniformity and simplicity in comparison with the citation scheme used up through the mid 1800's. When the nation began, reporting of American court decisions was quite primitive and fragmented. The publisher, or reporter, would give his name to the volume of reported cases and would number the volumes under that name sequentially; however, when the reporter’s name changed for that jurisdiction, the volume numbering would begin again at volume 1. These reports are often referred to as “nominative reports.” Later, legal publishers saw the need to begin naming a set after the jurisdiction (ex. ALABAMA REPORTS) and numbering sequentially all of the reporters within the jurisdiction, going back and renumbering the nominative sets for that court. Despite the fact that this change occurred many years ago, the legacy of confusion created by the nominatives still lives with us. Many of the citations in older case law will still reflect volume numbers of the nominative reporters rather than the renumbering scheme of the later jurisdiction-titled reporters. In addition, the nominative reporters often show only the nominative volume numbering on the spine and title page. As a result, looking up nominative case cites, such as 9 Mart. 286, can be quite a challenge. What is a current day legal researcher to do? An abbreviations guide can be a good start–try DICTIONARY OF LEGAL ABBREVIATIONS USED IN AMERICAN LAW BOOKS (KF/246/.B46/1985/Reference). HeinOnline Expands Coverage

HeinOnline continues to expand its image-based, fully searchable collection of legal resources. In addition, a new user-friendly interface streamlines the search function. A handy "citation navigator" allows quick retrieval of an article or other document by volume and page number. The "search" button displays all available search options for a particular collection. Click on "help" for context-sensitive instructions as needed. Use the "collection index" to browse by volume. Swiftly growing to an astonishing 8.7 million pages, the database now includes four components.

1. U.S. Supreme Court Library

This module contains an exact reproduction of Supreme Court cases in the official U.S. Reports from 1754 to date. The collection also includes preliminary prints and slip opinions. Find cases by citation, by party name, or search the full text for keywords and phrases.

2. Treaties and Agreements Library

Hein offers both historic and current documents in this database of U.S. treaties. Corresponding print sources include U.S. Treaties and Other International Agreements (UST) (1950-1984); Treaties and Other International Agreements of the U.S. (Bevans) (1776-1949); Treaties, Conventions, International Acts, Protocols and Agreements (Malloy) (1776-1937); Treaties and Other International Acts of the U.S. (Miller) (1776-1863); Treaties and International Act Series (TIAS 11060 - TIAS 12734); and KAV Agreements (Unpublished and Unnumbered Treaties and Agreements) (1987 to date). Users may browse by volume or treaty number. Alternatively, search by keyword, phrase, country, date, subject, and many other criteria.

3. Federal Register Library

This segment of the database includes every Federal Register issue from 1936 (Volume 1) to 1980 (Volume 45). Users may browse by volume, jump directly to a specific citation, or execute full text keyword and phrase searches.

4. Law Journal Library

HeinOnline provides full text access to pre-1980 journals, a segment typically omitted on Lexis or Westlaw. Though well known for covering legal history, Hein no longer restricts the database to older articles. The publisher continually adds new publications and recent issues. As of February 2004, HeinOnline covers 409 journals with another 279 under contract for future inclusion. The publisher estimates the cost of this journal collection in hardcover at $465,000 or more. The full text database displays exact page images complete with illustrations. Conduct keyword searches limited to the author or title fields. Alternatively, broaden retrieval with a full text search of every word in the database. Other handy features allow users to limit searches by journal or date, pull up an article by its citation, or view a table of contents for each volume.

Searching older journals on HeinOnline often leads to fascinating information. For instance, in the early 1890's, average annual tuition in U.S. law schools ranged from $20 (University of Texas) to $150 (Columbia and Harvard). Tuition at Cumberland was $50. 1 Intercollegiate Law Journal 117 (1891-1892).

What is GWGuardian?

In January 2004, Samford implemented a system to filter spam e-mail and improve the ability to catch viruses attached to incoming e-mail. This product is called GWGuardian. Spam messages and e-mail with viruses will be held in quarantine for one week.

Several times a week, e-mail users will receive an e-mail titled Virus and Spam Report. This report gives a list of questionable e-mail.

The spam messages may be deleted or released. Messages with viruses may not be released, they may only be deleted.

E-mails from senders that are not spam occasionally will appear in the quarantined list. These e-mails should be released from the list. To release a message, click the Release link. Once the link to release a message from spam quarantine has been clicked, a web page will open and will confirm that the message has been released to the Mailbox. The sender may then be added to a list of trusted addresses. Addresses that are trusted should not appear as spam mail again.

The same process occurs when deleting messages with viruses – a web page will appear and a notice will let the user know that “All messages marked as virus have been successfully deleted.”

Welcome

On February 3, Connie Walker joined the Law Library staff in the position of Law Library Assistant (Serials).

Mrs. Walker has a B.A. degree in Political Science from the University of Alabama. She has work experience at a law firm, a day school, the U.S. Post Office, the U.S. Steel Corporation, and the Goldome Credit Corporation. She is replacing Nima Pareek who recently retired. Nima worked in the Law Library for 16 years.

UA’s Gilded Legal Ethics : An Interesting Treatise on Alabama Ethics Rules’ Origins

For those of you with an interest in the history of attorney ethics, GILDED AGE LEGAL ETHICS: ESSAYS ON THOMAS GOODE JONES’ 1887 CODE (KFA76.5/.A2/A753/2003) by Carol Rice Andrews, Paul M. Pruitt, Jr., and David I. Durham, will be an interesting read.

Produced by University of Alabama’s Bounds Law Library, the book explores the history of Thomas Goode Jones’ efforts in creating the first Code of Ethics for the Alabama State Bar Association, a work that was adopted in large part as a framework for the first Canon of Legal Ethics of the American Bar Association. Mr. Jones was the governor of Alabama from 1890-94. The book includes illustrations and a facsimile of the original CODE OF ETHICS ADOPTED BY THE ALABAMA STATE BAR ASSOCIATION, DEC. 14, 1887.

David Bradley spent five minutes writing the computer code that has bailed out the world's PC users for decades.

The result was one of the most well-known key combinations around: CtrlAltDelete. It forces obstinate computers to restart when they will no longer follow other commands.

Group Points out Wacky Warning Labels

It is a warning label that may seem perfectly logical — to fish: A 5-inch fishing lure with three nasty steel hooks advises that it is "Harmful if swallowed."

If only carp could read.

The label took fourth place in the seventh annual Wacky Warning Label Contest. But organizers of the contest, the Michigan Lawsuit Abuse Watch, say it highlights the lengths to which manufacturers will go in order to avoid lawsuits stemming from misuse of consumer products.

"Wacky warning labels are a sign of our lawsuit-plagued times," said Robert B. Dorigo Jones, president of the nonprofit group working to raise public awareness of how the explosion in litigation is harming the country.
